Midsummerfest Liability Release — required to attend

In consideration of the use provided by Midsummerfest and Ian Dowell of the property in Royalton, Vermont owned by R. Chris Dowell of 230 Western Avenue, Sherborn, Massachusetts (hereafter referred to as “the MSF campsite”), you must agree to hold harmless, defend and keep indemnified Midsummerfest, Ian Dowell, and R. Chris Dowell and each of their heirs, successors and assigns (collectively referred to herein as “Midsummerfest”), from and against any and all claims, demands, liabilities, damages, judgements, suits, costs, and expenses (including attorney’s fees), due to personal injury, including death, property damage, including loss thereof, or otherwise, arising, or alleged to arise from use of or presence on the MSF campsite allowed to you by Midsummerfest heretofore or hereafter, regardless of how or by whom the property is used, and which may be made against Midsummerfest by you or by any third parties claiming against Midsummerfest in consequence of you or any such parties having used said property, whether the act, error, omission or negligence of Midsummerfest contributed thereto.

This indemnification agreement supersedes and shall supersede any conflicting terms or any acknowledgement, contract, or other similar document heretofore or hereinafter executed or agreed to by you and us. In the event this indemnification is terminated by either you or us, your obligation to hold harmless, defend and indemnify shall survive for such property use allowed you by Midsummerfest prior to the termination of this indemnification agreement.

Midsummerfest COVID Vaccination — required to attend

By the date of Midsummerfest, I will be fully vaccinated against the Covid virus.

Midsummerfest Splatball Liability Release — required to play Splatball

In consideration of the use provided by Midsummerfest and Ian Dowell of “Splat” guns, marking pellets/capsules, and accessories, you must agree to hold harmless, defend and keep indemnified Midsummerfest, Ian Dowell, and R. Chris Dowell and each of their heirs, successors and assigns (collectively referred to herein as “Midsummerfest”), from and against any and all claims, demands, liabilities, damages, judgements, suits, costs, and expenses (including attorney’s fees), due to personal injury, including death, property damage, including loss thereof, or otherwise, arising, or alleged to arise from use, maintenance, or control of any of the guns, marking pellets/capsules, and/or accessories lent to you by Midsummerfest.
